Which States Actually Cap Rent Increases? (Only 3 Do, in 2026)

Ask any renter what "rent control" means and you'll get a different answer every time - because in practice, almost no state actually caps rent increases. Out of 50 states plus D.C., only 3 have a statewide numeric cap: California, Oregon, Washington. The other 48 let a landlord raise rent by any amount, as long as they give proper notice.

The states with a statewide cap

"My city has rent control" - how that's different

Statewide caps are rare, but local rent control is more common than this list suggests - cities like New York, San Francisco, Los Angeles, and Burlington regulate rent independently of their state's law (in fact several of those states otherwise have no statewide cap at all). If your city has its own rent stabilization board or ordinance, it can be stricter than anything on this list. Always check city rules on top of state rules.

No cap doesn't mean no rules

Even in the 48 states with no cap, landlords still can't raise rent whenever they want:

• They generally can't raise rent mid-lease unless the lease specifically allows it.
• They still owe you written notice - commonly 30, 45, 60, or 90 days depending on the state.
• An increase can still be illegal if it's retaliatory (e.g., right after you complained about a repair) or discriminatory.
