The implied warranty of habitability is a legal guarantee, read into almost every residential lease automatically, that the home will be fit to live in: working heat and plumbing, a sound structure, no vermin infestations, basic safety.
Because it's 'implied,' it applies even if the lease never mentions it - and in nearly every state you cannot sign it away. A clause waiving it is generally void.
Watch out
A lease clause saying you accept the unit 'as-is' or waive habitability is one of the clearest red flags a lease can contain.
